Cape Town – Manchester City bad-boy, Carlos Tevez may take manager, Roberto Mancini to court in a defamation of character lawsuit.
Tevez was fined four week’s wages (approximately R12.7 million) after the club found that Tevez had refused to play and say that he breached his contract on ‘five separate occasions’ in their Champions League defeat to Bayern Munich.
However, according to reports on BBC Sport’s website, sources in the former Boca Juniors striker’s camp say that Mancini’s post-match comments in Munich could amount to defamation.
Tevez was subsequently suspended from the club for two weeks by City on September 28, pending the investigation’s conclusion, to which the club has since decided not to extend his suspension.
He is therefore available for selection for City’s Carling Cup trip to Molineaux against Wolverhampton Wanderers. His last match for the Skyblues took place more than a month ago, also in the Carling Cup, against defending champions, Birmingham City.
He has 14 days to appeal the club’s decision, after which he has the option of approaching the Premier League tribunal if he is unsuccessful.
City cite “an obligation to participate in any matches in which the player is selected" and “failure to follow the instructions of his manager” as two of the five breaches of Tevez’s contract.
Tevez’s legal team are not satisfied with the ruling and insist that none of the reasons given by City in the ruling constitute can correctly uphold the charge of misconduct and that Mancini’s allegations after the match in Munich can then constitute defamation.
This will add to the already tumultuous time Tevez has had at Eastlands after initially expressing a move away from the club in December 2010. He has since played a pivotal role in the club’s recent success, captaining the side to the 2011 FA Cup, City’s first triumph in 35 years, before putting in another transfer request, almost returning to Brazilian club, Corinthians.
He looks set to exit when the next transfer window opens in January and does not look like adding many more, if any more to his five appearances for the Premier League leaders this season and continues to train on his own.
