Mosimane threatens lawsuit

Johannesburg - Former Bafana Bafana coach Pitso Mosimane is threatening a lawsuit against the SA Football Association (SAFA) for unfair and unlawful dismissal, according ot his lawyers.

In a letter addressed to SAFA chief executive Robin Petersen from Mosimane's new lawyers (his first withdrew earlier in the week due to "conflict of interest") his legal team requested a meeting with the association to finalise compensation within 30 days.

"We advise that we act for Mr Pitso Mosimane, the former coach of the national soccer team of South Africa," his lawyers, Cowan-Harper Attorneys, said in the letter.

"On the instruction of our client we have attempted to contact you during the morning of Wednesday, 6 June 2012.

"The employment of our client has been unfairly and unlawfully terminated by SAFA and accordingly our client is entitled to refer a dispute to the CCMA.

"It may however be possible for the parties to resolve their differences and accordingly we wish to arrange a meeting in order to discuss the matter."

Mosimane was fired on Monday night, two years into a four-year contract, following a disappointing 1-1 draw against Ethiopia in Rustenburg in their opening 2014 FIFA World Cup qualifying match.

It was the national team's seventh consecutive game without a win.

During his two years in charge, Bafana also failed to qualify for the 2012 Africa Cup of Nations after team management, led by Mosimane, bungled the rules.

Interim coach Steve Komphela took over on Tuesday ahead of their second World Cup qualifier against Botswana in Gaborone on Saturday and a friendly international against Gabon next week.

"As the 30-day period in terms of the Labour Relations Act which applies for the referring of the dispute is now running, it will be necessary for the meeting to be arranged as soon as possible," Mosimane's lawyers said in the letter to Petersen.

If they did not hear from Petersen, they said Mosimane would refer the dispute to the CCMA.

"We trust that the matter can be resolved on an amicable basis," the letter read.

Petersen, however, poured cold water on the threat made by Mosimane and his attorneys.

"I don't think it will get that far, but if that is the road they want to take, then it's fine," Petersen said.

"As the [press] release [on Tuesday] said, we agreed amicably on the coach leaving and had telephonic conversations with different lawyers.

"The amounts of the agreement were discussed, but not resolved.

"It is part of life and the labour laws we live in, and unfortunate that we'll have to argue in public about it."

      o shame SAFA is one big joke, I lost all faith in them when they let Carlos Queiroz go, oh and dont forget why he left (Bafana started performing when Carlos was coach so they installed old Jomo Sono to share the coaching job). I put my house on it that if Carlos was given the opertunity Bafana would be the best in Africa and in the top 15 in the world. Typical South Africa "if it and broken BREAK IT"

      @rikhoula - clearly many fail to understand what performance driven results are and the record speaks for itself against Pitso...I'm pretty sure those terms and conditions are there in black and white on his contract, unless SAFA did what they are famous for by not doing so which would be no surprise. Pitso should take the R5-million settlement considering his hefty R800K a month salary that he's been getting for the past 2-years...How greedy would one have to be if he wants more. Simple maths - he earned just under R20-million before tax plus this supposed R5-million - how many people can say they've earned R25million in 2-years. Those are CEO salaries for crying out loud!!! Give us a break Pitso - you can find another job where you'll earn at least R300K a month very soon. Meanwhile what you've earned can keep you going for a good 5-years if invested wisely. No Johnnie Walker Blue Labels and Aston Martins.

      I have been reading the comments here & some people hardly make sense seriously. How do you say SAFA is stupid for giving Pitso a 4year contract like they knew that he wont perform? When every employer gives a contract to an employer they do that with a hope to perform so if you think SAFA was stupid to do that then I'm afraid you are the one who is dumb. Most teams offers their coach a minimum of altleast 4years contract but that doesnt guarantee their employee to finish the term if he's not performing.

      there was Arnold.He was supposed to take BB to AFCON in 2012,atleast semis when we host it and to Brazil 2014.So according to the contract he was supposed to be fired last year.It was def perfomance based.

    Pitso must just give up man and let Khompela lead us to the promise land.. Pitso got a fair chance to prove himself but he failed. We cannot allow you to run SA team like a club. This is the nation pride and there is lots of coaches that can give good results. You can't get this job again man, move on just like others!!!     Is Pitso Mosimane the right man to lead Bafana Bafana post-SWC? 56% voted Absolutely, he's paid his dues as an assistant coach. I will call Pitso a rat, snake and weasel if he tries to sue SAFA. He had more than enough time to prove himself. As the poll shows, SAFA and the public gave him a chance. He should be respectful enough to know that his time was up. That irks me that he wants to swindle some more now.
