Bakkies: Official statement

Johannesburg - The Appeal Committee has dismissed the appeal by Bakkies Botha against the finding of Breach of Law 10 (4) (j) - by dangerous charging in a ruck or maul without binding.

On appeal, the rules dictate  that the appellant carries the onus of proof that the decision of the Judicial Officer should be overturned or varied - this onus was not discharged on the facts. As a result and on those grounds, the appeal was dismissed.

However in the course of comprehensive and able submissions by Mr Gerrie Swart for the appellant, a very important point of principle was developed as to the proper application of this Law and in particular when a player lawfully binds or attempts to bind for the purpose of this Law.

The Appeal Committee will set out its conclusion in a full decision as soon as possible. However that conclusion would not have influenced the decision reached.

The appeal against the penalty was dismissed.

    Once again the diciplinary officials turn out to be a bunch of bumbling amateurs who don't share the love of rugby with the paying public.Bakkies is a hard and robust player in the best Blue Bull and Bok tradition,now some limp wristed official has the power(if not the insight)to put this great forwards international career on ice for two weeks.

    Genis - it is easy to state you "would like to walk into Bakkies in a BAR and the show him" on a site like this. Remember Bakkies is not just any old "bully" - he is a very very large "bully". As my Mom always tells me - do not wish for something you might regret!! I think a "Lion" (a real one) would sh...t itself it walked into a bar a met Bakkies. Bakkies is the Bok "enforcer" and he does a great job. Bakkies enjoy the break boet - the Tri-Nations is on its way.

    Bakkies has been walking a tightrope for ages and was lucky to escape a 2nd punishment in the S14. He is anything BUT a clean or fair player and constantly relies on out and out thuggery rather than ability. How he manages to balance that with his so called Christian views is diabolical. What annoys me most is that he is a talented player and has absolutely no need to resort to the sort of tactics that he does. Look at Matfield, a hard uncompromising player who does'nt stoop to Bakkies's level. So to the great John Smit - hard, fiercesome and dedicated but plays the game the way it should be. Sorry, but I have no sympathy for Bakkies or his myopic Bulls supporters.

    Hey 'Genius', Simon Shaw is one of the dirtiest players around - and has as many yellow cards as the worst of them around. He got away with a number of high tackles last weekend, but then again, being so one-eyed like all the mud island inhabitants, you wouldn't have noticed that would you ?

    Immediately after Bakkies cleaned out Jones , a Lions player came in from the side and did exactly the same thing to Bakkies yet was neither cited nor punished . Even worse , it was obviously done in retaliation . How sick is that citing commissioner ?

    We are constantly hammering on the Schalk Burger issue, I do however want to ask why we label him as such a dirty player? Can anyone please give me an example other than the latest or his so called dirty play? Or is it that he is just like Bakkies, the most physical opponents you would ever have to play?

    That was a bit stupid from Bakkies Botha anyway. Genis, I will not go as far as say that bakkies is the dirtiest player - but he right up there. Mr. Burger on the other hand should count his lucky stars. Truth is that South African players tend to draw on the short straw when it comes to citings and hearings, but then again, if you look at our record in the past, it shows why they are so strict. Maybe one day we will not feel so hard done by. Cameron

Fact is Bakkies has been cited and lost the appeal for what any rugby fanatic will tell you is textbook forward play. The commisioners official statement was that the boks couldn't prove bakkies bound (as thats what they would have had prove to win the appeal). Point is, they admit that a new principle was developed, but that this new principle did not affect the apeals decision). I theorise that the new principle would have cleared bakkies and thus ask the question of why wasn't it applied in his case if they admit to having developed it!!! A bunch of the old guard (i.e. BIL supporters) trying to level the playing field??? Ok thats my 2 cents conspiracy theory (which assumes I understood the report correctly, hehe)

    Question is, are they going penalise (or cite) every single incidence of ruck cleaning from today on? The rules also state that scrum feeds must be straight and down the middle - is this going to be enforced? And players (like the injured Jones) who aren't actually part of the ruck but "stand guard" on the fringes - are they going to be blown up for obstruction? If the Woolly Welshman hadn't been loitering, Bakkies wouldn't have felt the need to move him aside.

    I must say that he(bakkies) does give me the impression that he's out to hurt players in a bullying type of way. Granted, he is a physical player , but i generally look down on people who so obviously hide behind rule technicallities to try to hurt others. If someone asked me who the dirtiest player in SA is, I'd have to say ol Bakkies. Remember how OS used to cut down backline players with his amazing textbook tackles. Imagine if he had Bakkies' attitude? It would have been ugly and he wouldn't be the legend he is today.(Honniball, Braam v Straaten, DeWet Barry, Wickus, etc etc are all guys who can and did DRILL other players without being a pig about it. In fact, what bakkies does is a bit embarrassing for me. It reeks of insecurity-(funnilly enough).His type of play is the reason a lot of foreigners don't like us as a culture. He really could be an even better player if he focussed on being more constructive and hence more LETHAL. Butch used to late tackle guys after they'd passed and weren't expecting it.("cheap shot"). I always thought less of him after that.
