Madrid - The Spanish federation's appeal's commission has upheld Luis Suarez's two-game suspension for insulting opponents in a Copa del Rey match.
Barcelona says on Tuesday it will take the case to a higher sports tribunal in Spain in hopes of having Suarez back. It plays city rival Espanyol on Wednesday in the round of 16.
Suarez was suspended for a post-match altercation in the tunnel after Barcelona won the first leg 4-1 in a heated game that saw two Espanyol players sent off.
The referee's report said Suarez told Espanyol's players he was "waiting" for them and that they were "trash."
If Barcelona fails in its second appeal, Suarez will miss Wednesday's game and the first leg of the quarterfinals.
