Mosimane threatens lawsuit

2012-06-06 16:51

Johannesburg - Former Bafana Bafana coach Pitso Mosimane is threatening a lawsuit against the SA Football Association (SAFA) for unfair and unlawful dismissal, according ot his lawyers.

In a letter addressed to SAFA chief executive Robin Petersen from Mosimane's new lawyers (his first withdrew earlier in the week due to "conflict of interest") his legal team requested a meeting with the association to finalise compensation within 30 days.

"We advise that we act for Mr Pitso Mosimane, the former coach of the national soccer team of South Africa," his lawyers, Cowan-Harper Attorneys, said in the letter.

"On the instruction of our client we have attempted to contact you during the morning of Wednesday, 6 June 2012.

"The employment of our client has been unfairly and unlawfully terminated by SAFA and accordingly our client is entitled to refer a dispute to the CCMA.

"It may however be possible for the parties to resolve their differences and accordingly we wish to arrange a meeting in order to discuss the matter."

Mosimane was fired on Monday night, two years into a four-year contract, following a disappointing 1-1 draw against Ethiopia in Rustenburg in their opening 2014 FIFA World Cup qualifying match.

It was the national team's seventh consecutive game without a win.

During his two years in charge, Bafana also failed to qualify for the 2012 Africa Cup of Nations after team management, led by Mosimane, bungled the rules.

Interim coach Steve Komphela took over on Tuesday ahead of their second World Cup qualifier against Botswana in Gaborone on Saturday and a friendly international against Gabon next week.

"As the 30-day period in terms of the Labour Relations Act which applies for the referring of the dispute is now running, it will be necessary for the meeting to be arranged as soon as possible," Mosimane's lawyers said in the letter to Petersen.

If they did not hear from Petersen, they said Mosimane would refer the dispute to the CCMA.

"We trust that the matter can be resolved on an amicable basis," the letter read.

Petersen, however, poured cold water on the threat made by Mosimane and his attorneys.

"I don't think it will get that far, but if that is the road they want to take, then it's fine," Petersen said.

"As the [press] release [on Tuesday] said, we agreed amicably on the coach leaving and had telephonic conversations with different lawyers.

"The amounts of the agreement were discussed, but not resolved.

"It is part of life and the labour laws we live in, and unfortunate that we'll have to argue in public about it."

Does anybody understand the rules of Poor work Perfomance? Lol what a joke, give it a rest Pisto

      tyron.fawcett - 2012-06-06 17:20

o shame SAFA is one big joke, I lost all faith in them when they let Carlos Queiroz go, oh and dont forget why he left (Bafana started performing when Carlos was coach so they installed old Jomo Sono to share the coaching job). I put my house on it that if Carlos was given the opertunity Bafana would be the best in Africa and in the top 15 in the world. Typical South Africa "if it and broken BREAK IT"

      CharlesDumbwin - 2012-06-06 18:58

Some people don't understand it, rikhoula. They still believe in their brains that they are simply entitlted to things ...

      lerato.selane - 2012-06-07 09:48

Whats the chance there is a performance clause saying he will only be paid R5M if perfomance is poor and that he didn't read it?? Like he didn't read the AFCON qualifications??

      sabongam - 2012-06-07 10:10

@rikhoula - clearly many fail to understand what performance driven results are and the record speaks for itself against Pitso...I'm pretty sure those terms and conditions are there in black and white on his contract, unless SAFA did what they are famous for by not doing so which would be no surprise. Pitso should take the R5-million settlement considering his hefty R800K a month salary that he's been getting for the past 2-years...How greedy would one have to be if he wants more. Simple maths - he earned just under R20-million before tax plus this supposed R5-million - how many people can say they've earned R25million in 2-years. Those are CEO salaries for crying out loud!!! Give us a break Pitso - you can find another job where you'll earn at least R300K a month very soon. Meanwhile what you've earned can keep you going for a good 5-years if invested wisely. No Johnnie Walker Blue Labels and Aston Martins.

What a chop you are Mosimane get over yourself, you failed dismally i mean any employer would have let you go but then again there something that cANCEr calls Affirmative Actions, so i guess you can throw your toys around.

  • hiltonh - 2012-06-06 17:06

In Labour terms, gross negligence is reason enough for termination. - so take your 20 million plus settlement and piss off.

      Hugo - 2012-06-06 22:54

he will get much less than that because his contract said his salary and employment was perfomance based.so he failed to perform and was fired.he is making a fool of himself which will leave him broke with a poor reputation. You dont mess with the SAFA mafia.

  • Nicholas - 2012-06-06 17:06

The millions he is going to get for screwing up (a South African tradition) is not enough ...he is now going to see how much more he can bleed out of it. I'm sure there are one or two lawyers circling about as well ..

      Steven Hendricks - 2012-06-06 17:55

pitso must just go why he still wants to take safa to court eish i really don't know

      Nicholas - 2012-06-07 08:12

      Money ....thats why!

      sabongam - 2012-06-07 10:23

Money - the root of all evil - and right now Pitso is proving to be the devil re-incarnate. He must just voetsek and STOP with his voet, voet nonsense.

      Nicholas - 2012-06-07 11:02

It is the love of money that is the root of all evil ...

  • ntombiziyabusa.bhengu - 2012-06-06 17:10

Pitso Mosimane must be given, only and all of, what is due to him if its due to him. No matter how anyone feels about it. We must never skimp on justice.

  • razz.tazz.9 - 2012-06-06 17:10

PITSTOP!! You qualify for ASS H@LE of the month. What a joke. You got R5m to walk away with and now you want to spend it on legal fees. If you don't understand your contract with SAFA, how the hell will you understand the game. No wonder you could'nt produce results.

  • Moses - 2012-06-06 17:10

Typical of Pitso entire reign....arrogant and ignorant. He is an ass....but in typical SA fashion feels he deserves a golden handshake. Anyway SAFA deserve it...the whole mess around bafana is down to those idiots. from the time Barker left SA national soccer has been in decline...but those fat cats of SAFA stay on and the minister of sport does nothing. Soccer has the greatest potential of all the sports if it is run properly from the top...but sadly no one cares!!!!

      Stormkaap - 2012-06-06 19:01

Moses, a typical scenario of someones who thinks he is capable, but actually incapable and unwilling to take lessons... I say he must ride off into the sunset... maybe to a club where he can be a beeg feeesh

  • Francois - 2012-06-06 17:12

  • Johan - 2012-06-06 17:29

Sounds about right considering we are in Africa .Opportunism rules , Selebi , Cele , Mdluli .Will cost us millions to get rid of them. Huge exitement , at the beginning counter balanced by poor performance , poor duration poor , poor poor ....... You poor soccer supporters Pitso No 2 No 3 No 4 is destined to follow. You may not see any Cup of significance before Jesus comes .

  • Thabang - 2012-06-06 17:30

Pitso's mistake was to promise the country and SAFA that He can use Uno to race in formula 1 and win.

      CharlesDumbwin - 2012-06-06 19:00

Thabang you have summed it up perfectly, SA players are NOT the best in the world and just because we paint this team differently every year, does not make them perform better. I love our national teams, but our soccer is USELESS !!!

      Hugo - 2012-06-06 22:57

      so says the KKK christian

  • mpho.c.moreki - 2012-06-06 17:30

I thought as much,it is now clear that this big headed coach went to coach Bafana only to serve his own interests not that of the nation.why cant he accept that he failed to put bafana at an international standard and give those who can do a better job a chance?aag maan, leha ke sa tsebe bolo

  • meluski.rodwevich - 2012-06-06 17:34

    Pitso must go to hell

  • luzuko.qongo - 2012-06-06 17:35

SAFA, there is no cure for your stupidity when it comes to running all the national teams. Youve been running our national teams like spaza shops. pitso was appointed against many objection from the football fraternity, knowing what disaster will be visited upon the national team.

      Fhulufhelo Bobstar Takalani - 2012-06-06 18:40

I have been reading the comments here & some people hardly make sense seriously. How do you say SAFA is stupid for giving Pitso a 4year contract like they knew that he wont perform? When every employer gives a contract to an employer they do that with a hope to perform so if you think SAFA was stupid to do that then I'm afraid you are the one who is dumb. Most teams offers their coach a minimum of altleast 4years contract but that doesnt guarantee their employee to finish the term if he's not performing.

  • arnold.niemand - 2012-06-06 17:36

Was there perhaps a performance clause written into the contract? once again mediocrity being rewarded.

      Hugo - 2012-06-06 22:59

there was Arnold. He was supposed to take BB to AFCON in 2012,atleast semis when we host it and to Brazil 2014.So according to the contract he was supposed to be fired last year.It was def perfomance based.

  • Staal - 2012-06-06 17:43

    Some "amicable" agreement!

  • shongwepatrick - 2012-06-06 17:49

He's crazy , go to hell Pitso,

  • nhlanhla.ndlovu.10 - 2012-06-06 17:49

Robin Peterson and Nematsandani must resign, how can you give a palooka like Mosimane a four year contract. If they are unwilling to resign, they must pay him out of their own pockets.

  • josefaramelato.mthombeni - 2012-06-06 17:51

Pitso must just give up man and let Khompela lead us to the promise land.. Pitso got a fair chance to prove himself but he failed. We cannot allow you to run SA team like a club. This is the nation pride and there is lots of coaches that can give good results. You can't get this job again man, move on just like others!!! Steve Khompela my homeboy is the right candidate and he deserves this moment. It was going to be unfair for Steve to be led by an under performing Pitso. Viva Steve Khompela Viva!! Gud work SAFA and gud decision!! Keep it up!!

  • peter.mokoena.31 - 2012-06-06 17:51

Come on Pitso, your right should not supercede the interest of the nation. Be patriotic enough to to note your ineffectiveness of how let the whole naton down and yet you still want to continue. Let go, you should be well off financially. We want to go to Brazil and play in 2014, not watch others play

  • sifiso.wisey - 2012-06-06 18:10

Pitso just give SAFA one reason not to fire you, when was the last time Bafana won a game,.,.

  • Lebo.Jeed.Tshepi - 2012-06-06 18:12

MR Mosimane u are so arogant. Shame on u.

      CharlesDumbwin - 2012-06-06 19:01

  • Richard - 2012-06-06 18:50

Guys am i reading this right. I thought u get paid for what u do? No offence but our soccer sucks compared to our rugby and cricket. Wonder what our coaches for rugby get compared to this idiot who can. t do anything with our soccer team. The sports coaches should be on a performance pay.

  • Jacques - 2012-06-06 18:56

Please take in consideration that Peetso is a previous disadvantaged cadre. He is entitled to anything . Safa they must e pay him millions for not doing de job so now she can be having freedom of economics and continue the economic revolution and struggle

  • Neal Sing - 2012-06-06 18:59

U were useless as a coach.Bow out gracefully.Let a more competent coach bring Bafana Bafana back to their glory days of Tovey,Williams, khumalo,Shoes, and Mkhalele;justto name but a few

  • joathanj - 2012-06-06 19:53

    His arrogance knows no bounds.

  • Paul - 2012-06-06 19:58

Is Pitso Mosimane the right man to lead Bafana Bafana post-SWC? 56% voted Absolutely, he's paid his dues as an assistant coach. I will call Pitso a rat, snake and weasel if he tries to sue SAFA. He had more than enough time to prove himself. As the poll shows, SAFA and the public gave him a chance. He should be respectful enough to know that his time was up. That irks me that he wants to swindle some more now.

  • shauns4700 - 2012-06-06 20:05

  • somikazi.pita - 2012-06-06 20:33

  • Gerhard - 2012-06-06 22:10

Shame.... is this about unjust treatment, bruised ego or .... mmmm... yea, it is all about the money is it not? Yep live the high live, stay in the spotlight, but.... perform or else (ask Snorre of rugby fame). This is not about a retrenchment as in "normal" employment. You knew what you were tackling when you took the job boykie, so dont expect sympathy from the fans. Imagine .... A 1 all draw against the mighty Ethopians... wow, next we face the powerhouse that is Botswana. Give me a break!! Given the supposed strength of our Premier league and the amount of money flying around relative to the situation facing these awesome competitors, why can we not win these games without breaking into a sweat? This is all high class bovine faeces.... You want some sympathy? tell someone who cares!!! Oh yes, when all else fails, let go to court, after that JZ's solution to matters where he is clearly offside.

  • monde.ngomane - 2012-06-06 22:19

Word of advice Mr. Pitso: Swallow your pride and apologise to the entire nation! You are a disgrace, you never even deserve the position!

      aleck.wellay - 2012-06-06 22:46

aaaa shame pitso. Bafana is run by fans ,so sue them 4 your failure. I heard an 8year old player crying for bafana bafana's better perfomance. Swallow your proud and let it go.
