Cape Town - SA Rugby has reported Windhoek Lager to the Advertising Standards Authority because of its use of the phrase "the green and gold beer" in one of its advertisements.

In its complaint, SA Rugby stated that Castle Lager, produced by the South African Breweries, is the official beer sponsor of the Springboks.

According to the complaint, the use of the phrase "green and gold beer" gives the impression that Windhoek Lager is the official sponsor.

SA Rugby stated in its complaint that the advertisement was broadcast round about June 16, midway through the British and Irish Lions tour to South Africa.

SA Rugby further states that the official name of the tour is the "Castle South Africa 2009 Lions Series".

SA Rugby further states that the use of the phrase on a dark green background with a gold border is purposefully chosen to make reference to the Springbok team.

According to SA Rugby, Castle, since its re-introduction to international rugby in 1992, has been sponsoring South African rugby in various ways and therefore no other beer has the right to refer to the SA Rugby trademark or the Springbok team.

SA Rugby further based their argument on the grounds that it clashed with the broadcasting code of conduct.

Brandhouse Beverages, who markets Windhoek Lager, in its defence, said that they have been marketing the colours of green and gold since 2002 in all marketing of the beer. According to Brandhouse, the term "green and gold" refers to the colours of the packaging of the beer.

Brandhouse insisted that they have been using this advertising campaign since July 2007.

ASA's decision-making board found that there was insufficient evidence that Brandhouse had transgressed the advertisement code . The decision-making board thus dismissed the complaint

They advised SA Rugby to lay a new complaint that is based on the sponsorship code.

@Stan, I was also weaned on Lion Ale and we used to call it No17. Those were the good old beer days in the 70's and early 80's. Also enjoyed Hansa Pilsener but now I sit in the Netherlands and enjoy an incredible range of beers. From Warsteiner,Bitburger,Grolsch,Hertog Jan,Dommelsch, Triple,Stella Artois to name a few.

Castle is only an average beer at best anyway. It is a shame that is all that you get at rugby and cricket. One of the reasons it is nicer to watch from home.

The reality is that The Lions were sponsored by Guinness - who happen to be owned by Diageo. Diageo also are the holding company for Brandhouse so it seems like a case of one area where The Lions' marketing guys and partners beat SA Rugby to the punch! Maybe SA Rugby will one day learn how to trully ensure value for their sponsors... Either way - well done to Windhoek! Clever tactic!

It looks like this has backfired on SAB! The average Bok supporter drinks Windhoek! As noted by Wouter....the Namibians drink Tafel Lager, now that is mothers milk. Why is it not more readily available? (Perhaps the crappy label?). Dude...your ballie is young, I was weaned on Lion Ale, then Lion Lager, interspersed with a few Rouges (picture of the factory on the can) Kronenbourg and Mt Luyts efforts!

If you do a wikipedia search for "Green and Gold" you will get the following an article which starts with the following: "Green and gold are the national colours of Australia, as proclaimed by Sir Ninian Stephen, the Governor-General of Australia on 19 April 1984" Funny, I think Aus should rather sue SA Rugby for using the term "Green and gold" as theirs, as it is clearly and officially the colors of Aus. Nevertheless, such phrase has never been registered as 'n trademark. What a bunch of idiots!

SA Rugby has over the years allowed the erosion of its intellectual property and trademarks, electronically with sarugby.com and in publications print magazines etc with SA Rugby and failed to defend that copyright infringement and as a consequence has relinquished its intellectual property - the only assets they have, other than the players under contract. It is a shame really as this undermines the value of their sponsorships and when the next round comes along to renew or entertain new sponsors, they will have this to contend with. It is open season.

I wonder if SAB read this report? Seems that support for Brandhouse and their fantastic products is much higher than SAB will ever acknowledge? My Experience of dealing with SAB was never pleasant.Even over here in Aus we still get to consume Windhoek, and whats even better? The price! its cheaper than the local Aussie beers!!

I would always out of principal rather support the smaller company of two rivals, in most instances the product is of a much better quality. In this instance it most certainly is. Tafel Lager is even better than Windhoek.....

Any idea how much money gets spent by multi million dollar companies to try and associate their brand with a sports team and what they fork out for sponsorships??? To them its an investment, they want to protect it. Now windhoek has seen the oppertunity and wants to jump on the bandwagon. If one mentions " green and gold" in SA, the first thing you think of is the Springboks. Windhoek is trying to make a quick buck with their advertising campaign. Sab is probably one of the biggest breweries in the world, if not the biggest. Doesnt that say something about the volumes they sell??? Castle probably being the biggest one of them all. Beer, like anything else is a personal preference. If i prefer to drive an Audi instead of a Merc, doesnt mean that Merc is crap.... I dont mind windhoek, but incase you're wondering, I DRINK CASTLE and love it!

Castle is a shocker. SAB only keeps pushing the brand because it is their historically dominant brand. Black Label and Hansa are far bigger sellers. Windhoek is a real beer! Run the Boks on Windhoek and we will get better results, and improved consumption! Viva Windhoek!!

The interesting (and funniest) part of this ruling is where SA Rugby states that "green and gold" is a term of endearment often used to describe the Boks and as such deserves protection as a trademark. Brandhouse's lawyers then produced a search report of SARugby.com where the phrase fails to appear. Not once!

Oh my word - what a load of rubbish. Firstly, I would never have remembered this Windhoek Advert if they SA Rugby didn't bring it up. (Which I am sure they are only doing under pressure from SAB) Ironically this will however just give Windhoek extra exposure. Secondly, how can you condemn a brand for advertising their colours just because they happen to be the same as yours? Personally, I drink Amstel - also green and gold - want to make them change there colours globally just in case people may get confused and think they are also aligned with SA Rugby. Maybe you need to look at Nedbank Golf Challenge - Green & Gold, Land Rover - Green & Gold. There is even a website listed as Green & Gold Rugby - it’s an Aussie rugby blog site - going to get that changed as well?????

What nonsense is this from "red and white" Castle and SA Rugby. I'm sure because Windhoek is real beer and in the interests of keeping it real the brand would want to be involved in a real good winning rugby team sponsorship. Not the cross little flower Protea/Springboks who on current form seem to have peaked and are on the way down. So let's just keep it real. The real green and gold packaging of Windhoek Lager. Drink real beer. And let's try and play real winning Springbok rugby!

This is ridiculous. Windhoek Lager had a green bottle with green lable and some form of gold border on the Logo for as long as I can remember. And the beer has a nice golden colour to it. So what is wrong in calling it the green and gold beer? Everything about Windhoek Lager is green and gold. The phrase "green and gold" is not a registered trademark of SA Rugby!! Get over yourselves and do something useful.

Good on Brandhouse, its about time SAB were put in their place. SAB were even kicked out at the Shark tank. Windhoek is made the correct way without all the chemicals SAB put in the beer. As for SA Rugby, its run by a bunch of fools as is most sporting codes in SA.
